For most Americans, estate taxes are no longer an issue with the estate tax exemption at $5,450,000. But even though you may not be subject to estate taxes, your heirs could be facing high capital gains taxes, depending on the assets you own and the type of estate plan you have. In addition, the President recently proposed lowering the estate tax exemption, going back to taxing estates for additional capital gains, and eliminating several types of tax savings trusts.
